It is important that you read through this document and are happy to agree with the terms and conditions set out below and then we can get on with all the magic and fun things! Please note that payment for services and engaging in the training classes both private and group also implies full agreement with these Terms and Conditions.

Training and Handling Methods

The training techniques used by Believe In Magic Dog Training & Behaviour are based on the principles of positive reinforcement and, as such, are kind, fair and reward-based. Harsh handling of dogs, physical force and the use of punitive methods/ punishment/ corrections or equipment designed to be aversive (including choke chains, check chains, prong collars, spray collars, e-collars or any other device deemed unacceptable by the trainer) are not permitted in classes or and should not be used in training.

PAYMENT, REFUNDS AND CANCELLATIONS

Statutory 14 Day Consumer Contract Regulations

If you choose to cancel a booking within 14 calendar days of receiving your booking confirmation, you are entitled to a full refund.  Usually, you can cancel by clicking on the appropriate button in the booking confirmation email.  However, if this is not possible, you would prefer to communicate with us first or there are any problems, please get in touch with us (info@believeinmagic.dog) and we will cancel the booking for you and issue your refund.

Cancellations, re-arranged bookings and refunds in circumstances outside the 14 day cancellation period are subject to the conditions set out below, in accordance with our standard terms.  For the avoidance of doubt, the cancellation period will expire after 14 days from the date of the order confirmation.
If you are booking a service to start within 14 days (i.e. within the statutory cancellation period), we will require express permission from you to start providing the service before the cancellation period ends.  You can grant this permission by ticking the appropriate box during the booking process accepting our Terms and Conditions.  If you subsequently decide to cancel the contract, you will be liable to pay us an amount that is in proportion to the services performed until you communicated your decision to cancel, in comparison to full coverage of the contract.
You will not have the right to cancel a contract where the classes have commenced.

Standard Cancellation and Refund Policy

Payment in full is required when booking a place at training classes, unless otherwise agreed.  After the statutory cancellation period (see above), this payment is non-refundable.  Occasionally, where a client is unable to take up their reserved place on a course, their credit may be transferred to another suitable class/ service; this is at the sole discretion of Believe In Magic Dog Training & Behaviour and will be dependent on us having another client to fill your place.  We are unable to offer any refunds on missed sessions but you will receive the handouts in your bound book with step by step guides on the behaviours taught within the course for which you have paid, whether you attended or not.

In the event that we have to cancel a training class for any reason (such as unforeseen circumstances/ adverse weather/ illness/ emergency), we may try to reschedule your session to another mutually convenient time. However, it is difficult to find alternatives to suit everyone involved and we are restricted by hall availability. Therefore, if we feel that it is not possible or practical for us to arrange an alternative session, we will refund you for the cost of the class by calculating this as a proportion of the full course cost paid.
If, despite adverse weather conditions or any other issues, we are still able to run a class but you are unable to make it to the session, we are sorry but we cannot provide a refund or any kind or an alternative session. In such cases, this will be treated as a ‘missed session’ on your part (see above) and you will simply be provided with any relevant follow-up information/ recap/ online content associated with the session for which you were unable to attend.

One to One sessions (including Supplementary Training Sessions) should be paid for a minimum of one week in advance of the booked time / date or at the time of making the booking. These can be re-arranged or refunded with at least 1 week’s notice. With less than 1 week’s notice, no refunds will be given (except for any travel charges paid but not incurred). In exceptional circumstances, a partial refund or re-arrangement for a One to One session cancelled with notice of between 1 week and 48 hours may be made, at the sole discretion of Believe In Magic Dog Training & Behaviour. The Puppy / New Rescue Private Class Package of visits must all take place within a three month period or any un-used sessions will be forfeited, except in exceptional circumstances, in which case they may be refunded or re-arranged at the sole discretion of Believe In Magic Dog Training & Behaviour.

Suitability for Class Environment [Not applicable to Training Support Sessions or ‘One to One’ Training]

Some dogs are not suited to a class environment due to over-arousal, fear, anxiety etc (this is not the same as a young puppy who is new to socialisation and is just a bit nervous!). Dogs which are known to be reactive to other dogs or people will not be best placed in a class environment; it is simply not fair on the dog or the other attendees. If your dog is not suited to the class training environment now, we may be able to offer alternative solutions, such as one to one training sessions. If a dog is deemed by the trainer to be particularly stressed or reactive, despite the efforts of the owner and/ or trainer, the owner will be asked to remove the dog from the class (for that session or the rest of the course), in the best interests of both the dog and the others attending. Therefore, if you are unsure how your dog will respond to a class/ group environment, or have any concerns, you should discuss this with us before booking on to a course; refunds for course fees will not be given (see above).

Safety

Any instances of accident or injury must be reported to the trainer at the time they occurred. A first aid kit is available at training classes and carried by all staff during one-to-ones and training support sessions. All dogs must remain on lead and kept away from contact with other dogs unless specifically instructed by the trainer (eg. off-lead play). Flexi leads (extending leads) are not permitted in class, to avoid injury.

Children

Children are very welcome to attend classes / training sessions. We just ask that there are two adult’s for children aged 6 and under, to ensure that your puppy/dog have one adults undivided attention and that children do not approach or touch any dogs without appropriate supervision and permission. We accept no responsibility for children at classes and it is the responsibility of the supervising adult to ensure the children’s safety at all times. In addition, children must not be allowed to disrupt the learning and we reserve the right to ask for disruptive children not to be brought to classes in the future. Young people under 16 must be accompanied by an adult.

Health and Vaccination

All dogs and puppies attending classes should be suitably protected from the potential risk of disease as well as being appropriately treated for internal and external parasites. Believe In Magic Dog Training & Behaviour advises that owners should consult their veterinary professional with regard to such issues. Whilst the indoor venues used by Believe In Magic Dog Training & Behaviour are not routinely accessed by dogs (other than those attending classes), there can be no guarantee that there is absolutely no risk of disease at any venue or when in contact with any other dogs or materials, such as toys, which may have been in contact with other dogs. We use Anistel a veterinary grade disinfectant both on the floors and toys.

It is the owner/ handler’s responsibility to ensure that their dog is appropriately protected against the risk of disease: Believe In Magic Dog Training & Behaviour accepts no responsibility for the potential or actual exposure of dogs to disease. If an owner chooses not to routinely vaccinate their dog / puppy (for example because they are choosing titre testing or using homeopathic nosodes), this is entirely the choice of the owner and is a decision made at their own risk. We do ask to have a copy of any titre testing periodically in line with vaccination guidelines too.

By booking a place at a class and agreeing to these terms and conditions, you are accepting full responsibility for the protection of your dog from the risk of disease. Please do not bring your dog to class if he or she has been in contact with another dog infected by a contagious disease or if they appear to be unwell (eg. vomiting, diarrhoea, coughing, runny nose etc). We accept bitches in season in class, we feel they exist in the real world and we want to help all our guardians understand how to help their dogs focus with seasons as distractions too, however if your bitch is ill, then we ask you do not bring her to class in line with the above health recommendations. If a dog is unable to attend classes, owners are encouraged and more than welcome to attend without their dog to keep up to date with the training course. If your dog has any known allergies or intolerances to certain foods or has any other special needs, it is your responsibility to bring this to the attention of the trainer prior to the start of the session.

Marketing/ Privacy

Photographs may occasionally be taken during training sessions. Such photos may be used by Believe In Magic Dog Training & Behaviour for the purposes of marketing. For example, weekly photos and graduation photos are posted on our Facebook page. If you do not wish for photographs of you and / or your dog to be used or shared, please let us know. Any written feedback (eg. by email or on feedback forms) may be used for marketing purposes (for example, posted on the website). Only the first name of the person will be used as identification. If you are not happy for us to use your feedback in this way, please let us know. Photography and videography is NOT permitted, without the express permission of Believe In Magic Dog Training & Behaviour.

Disclaimer

We make every effort to ensure the safety of both clients and dogs during training classes, training support sessions and one to one sessions. However, by making a booking with us, you are accepting that participating in an activity with dogs, children and adults poses a risk of injury to yourself and your dog, and you agree to indemnify Believe In Magic Dog Training & Behaviour for all personal injury and damage to property while attending training. You agree to assume full responsibility for any risks, injuries or damages, known or unknown, which might occur as a result of your dog attending classes / sessions. You also agree to make any person who accompanies you to the session(s), or takes your place, aware that they are also there at their own risk. You understand that your dog (and its behaviour) remains entirely your responsibility at all times, whether or not in the presence of the trainer / behaviourist.

New Puppy / New Rescue Private Consultation

These Terms and Conditions apply to any and all New Puppy / New Rescue Consultations. Please note that payment for services and engaging in the New Puppy / New Rescue Consultation both also imply full agreement with these Terms and Conditions.

With between 2 weeks’ and 1 week’s notice, a 50% refund will be given (plus any travel costs paid for but not incurred). With less than 1 week’s notice, no refunds will be given (except for any travel charges paid but not incurred) and a new session will need to be booked.

In exceptional circumstances, a partial refund or re-arrangement for a New Puppy or New Rescue Consultation session cancelled with notice of between 1 week and 48 hours may occasionally be made, at the sole discretion of Believe In Magic Dog Training & Behaviour.

In the event that we have to cancel a session with you due to unforeseen circumstances, such as adverse weather/ illness/ emergency, we will make every effort to reschedule your session to another mutually convenient time. If this is not possible, we will refund you for the cost of the session.

Safety

We ask that, unless previously agreed with us, all dogs are kept away from the front door, contained in another room, when we first arrive please. Depending on the issue, you may be asked to take additional steps to ensure safety (and also allow controlled observation of your dog’s behaviour) during a New Puppy or New Rescue Consultation. For example, if your dog is reactive to (or fearful of) people entering the home, you may be asked to keep them contained in another room until a specific point during the consultation. In any case, if you have any concerns about your dog’s behaviour towards visitors, yourself or anyone else present at the consultation (including other dogs) or are concerned that they may cause injury, it is entirely your responsibility to take all necessary steps (eg. muzzling the dog and/ or keeping them on the lead) to prevent this from happening. It is essential that you take sensible safety precautions and then discuss how and when the dog should be introduced during the consultation rather than take risks. You will be advised during the discussion how and when the dog(s) may be safely introduced to the room in which the consultation is taking place. If your dog has ever bitten a person or other animal, you must report this to us before the Consultation takes place so that we can advise you accordingly. Any instances of accident or injury occurring during the consultation must be reported to us at the time they occur.

Children

Children are welcome to be present at New Puppy or New Rescue Consultations, we encourage all members of the family to take part. It is the responsibility of the parents/ carers to determine whether or not it would be helpful or appropriate for any children/ other family members to be present at any point. It is important that at least one adult is able to give their full attention to the discussion throughout. We accept no responsibility for children and it is the responsibility of the supervising adult to ensure children are safe and their well-being is protected at all times whether before, during or after the New Puppy or New Rescue Consultation.

Privacy and Marketing

Photographs of your dog may, with your permission, be taken. Such photos may be used by Believe In Magic Dog Training & Behaviour for record keeping and/ or marketing purposes. By consulting Believe In Magic Dog Training & Behaviour with regard to your dog’s behaviour, you agree to fully engage with the process to the best of your ability and understand that any changes will involve commitment and consistency, in line with the pledge set out below. The pledge (below) sets out the responsibilities of both parties and is a gesture of your commitment to, and understanding of, the process which you are undertaking.

I understand that working with dogs and modifying behaviour poses a risk of injury. I agree to ensuring that necessary steps are taken at all times to prevent injury to myself, my dog(s) and others, including the use of a muzzle and avoidance of situations that might trigger aggressive behaviour. I agree to indemnify and hold harmless Believe In Magic Dog Training & Behaviour (Eryn Martyn-Godfrey) against any and all losses, liabilities, judgments, awards and costs (including legal fees and expenses) arising out of, or related to, any claim of injury to persons or property of any kind, whether before, during or after the consultation and when implementing suggested techniques with my dog(s).

Behavioural Consultations

These Terms and Conditions apply to any and all Behaviour Consultations. Please note that payment for services and engaging in the Behaviour Consultation both also imply full agreement with these Terms and Conditions.

Veterinary Care and Medical Issues

We are happy to take referrals from Veterinary Professionals or bookings for Behaviour Consultations directly from clients. In either case, we will ask your vet for your dog’s medical records. This should not cost you anything (vets and behaviourists work together as a matter of professional courtesy). In some cases, your vet check may ask to see the dog to rule out potential medical causes before the behaviour consultation takes place or prior to embarking on a behaviour modification programme. If, during or after the consultation, it is felt by us that a (further) veterinary check is advisable, it will be your responsibility to ensure that this is carried out before embarking on any behaviour modification strategies suggested at the consultation, as advised. We also reserve the right to communicate with your Veterinary Surgeon about your dog(s) at any time if we deem this to be necessary or helpful. If your dog has any known allergies or intolerances to certain foods or has any other special/ medical needs, it is your responsibility to bring this to our attention prior to the start of the session.

 

 

Children

Children are welcome to be present at Behaviour Consultations, although due to the nature of the discussions that will be taking place, this may not always be appropriate. It is the responsibility of the parents/ carers to determine whether or not it would be helpful or appropriate for any children/ other family members to be present at any point. It is important that at least one adult is able to give their full attention to the discussion throughout. We accept no responsibility for children and it is the responsibility of the supervising adult to ensure children are safe and their well-being is protected at all times whether before, during or after the Behaviour Consultation.

The Puppy Discovery Service – What it Includes:

Puppy Divination

  • Telephone assessment in which we find out everything we need to know about you and what you want (approx. 45 minutes)
  • Use of our expertise, prior knowledge, experience and research to match what we know about you with what we know about dogs
  • Personalised Puppy Discovery Recommendation Report written especially for you, in which we set out your best 3-4 matches in detail (explaining why each would be a good match for you, based on the information you have given) and highlight other options for you to consider if you’re still not sure

Puppy Discover

  • Research of appropriate, responsible breeders of your chosen breed with regard to the following factors:
  • mate selection of parents (inbreeding coefficient, temperament, health, age, number of litters etc.)
  • appropriate health screening of parents (dependent on breed)
  • early environmental influences (positive socialisation experiences, appropriate
  • exposure to stimuli and situations – such as being left alone)
  • living environment of the puppies and their mother
  • nutrition of the puppies (and their mother)
  • puppy vaccination and flea/ worming schedule
  • the breeder’s experience and offering to you as a potential puppy owner
  • Consideration of your preferred timescales for obtaining your puppy
  • Telephone or email feedback to you to share the findings of the breeder research to help you select the right breeder for you
  1. Depending on how far ahead of your preferred time for having your new puppy join your family, the Puppy Discover breeder search is carried out, this service can either consist of:
  1. an initial shortlist of appropriate breeders that are hoping/ planning to have a litter at some point around your preferred time (this gives you the benefit of getting on a waiting list)
  2. a shortlist of breeders which have confirmed pregnancies or current litters available at your preferred time (this give you more certainty but will rule out those with full waiting lists)

Puppy Determiner

  • Support on the big day (visit may last up to one hour)
  • Basic visual check of the health of the puppies and mother
  • Observation of and interaction with dam (mother) – basic temperament check
  • Basic visual check of the puppies’ living environment (and discussion with the breeder)
  • Discussion with the breeder about the litter – the temperaments and personalities of each puppy
  • Observation of the puppies to determine any significant character traits (dependent on age)
  • Guiding you in your choice based on the above but also taking into account your preferences and ‘gut feelings’
  • Checking the validity of what was discussed with the breeder during the Puppy Divination (if you opted for this service)

* Additional charges apply if travel is required outside South East London or the immediate area.

In exceptional circumstances, a partial refund or re-arrangement for a Puppy Discovery session cancelled with notice of between 1 week and 48 hours may occasionally be made, at the sole discretion of Believe In Magic Dog Training & Behaviour.

In the event that we have to cancel a session with you due to unforeseen circumstances, such as adverse weather/ illness/ emergency, we will make every effort to reschedule your session to another mutually convenient time. If this is not possible, we will refund you for the cost of the session.

Marketing/ Privacy

Photographs may occasionally be taken throughout the Puppy Discovery process. Such photos may be used by Believe In Magic Dog Training & Behaviour for the purposes of marketing. If you do not wish for photographs of you and/ or your dog to be used or shared, please let us know. Any verbal or written feedback (eg. by email or on feedback forms) may be used for marketing purposes (for example, posted on the website). If you are not happy for us to use your feedback in this way, please let us know. Our full Privacy Policy is available to view by clicking on the link in the footer of every page of our website or we are happy to provide a copy, on request.

Disclaimer

Whilst the Puppy Discovery Service is designed to support you in selecting the most appropriate puppy for your circumstances, it is important to understand that it is not possible to entirely predict the temperament, future health and suitability of any dog, due to the complexities of genetic inheritance and individual life experiences. We will use our best judgement to support and guide you through the process of choosing a puppy which will be well-matched to you (and have had great success with doing just this) but the very nature of sentient beings, influenced by a variety of factors, mean that we cannot make any absolute guarantees about the future behaviour, health, temperament, appearance, grooming needs (or any other specific characteristic) of any dog.

It is the responsibility of the individual(s) engaging in the Puppy Discovery service(s) to ensure their own safety and that of others for whom they are responsible (eg. children) at all times. By making a booking with us, you are accepting that visiting, handling and interacting with dogs poses a risk of injury to yourself and those with you and you agree to indemnify Believe In Magic Dog Training & Behaviour for all personal injury and damage to property while engaging in the Puppy Discovery process. In addition, there is a risk in both travelling to and visiting the homes of potential breeders and you must take any necessary precautions to ensure your own safety and that of any others with you. You agree to assume full responsibility for any risks, injuries or damages, known or unknown, which might occur as a result of you engaging in this process. You also agree to make any person who accompanies you in this process, or takes your place, aware that they are also there at their own risk.

Webinars & Remote Support

These Terms and Conditions apply to any and all Webinars and Remote Support. Please note that payment for services and engaging in a Webinar or Remote Support Consultation both also imply full agreement with these Terms and Conditions.

Techniques and Handling Methods Suggested 

The training techniques and behaviour modification methods suggested or shown to be used by Believe In Magic Dog Training & Behaviour are designed to be kind, fair, force-free and non-aversive. Harsh handling of dogs, physical force and the use of punitive methods/ punishment/ corrections or equipment designed to be aversive (including choke chains, check chains, prong collars, spray collars, e-collars or any other device deemed unacceptable by the trainer/ behaviourist) are not to be used.

Payment, Refunds and Cancellations

Any Webinar or Online Course must be paid for at the point of booking.

Statutory 14 Day Consumer Contract Regulations

If you choose to cancel a booking within 14 calendar days of receiving your booking confirmation, you are entitled to a full refund. Usually, you can cancel by clicking on the appropriate button in the booking confirmation email. However, if this is not possible, you would prefer to communicate with us first or there are any problems, please get in touch with us (info@believeinmagic.dog) and we will cancel the booking for you and issue your refund.

Cancellations, re-arranged bookings and refunds in circumstances outside the 14 day cancellation period are subject to the terms and conditions as set out below, in accordance with our standard terms. For the avoidance of doubt, the cancellation period will expire after 14 days from the date of the order confirmation.

If you are booking services to start within 14 days (i.e. within the statutory cancellation period), we will require express permission from you to start providing the service before the cancellation period ends. You can grant this permission by accepting our Terms and Conditions during the booking process. If you subsequently decide to cancel the contract part way through a package, you will be liable to pay us an amount detailed in our Standard Cancelation Policy below at the point you communicated your decision to cancel, in comparison to full coverage of the contract.

You will not have the right to cancel a contract where the services have been fully performed.

Webinars / Online Courses

Voluntary refunds:

(a) If you work through the first few modules of an online course are not totally happy with it, then we will refund your money. Unless stated otherwise, the Chaotic to Calm Fireworks Course has  a 7 day money back guarantee and refund period.

I believe in our training and courses and thousands of dogs and their guardians have experienced fantastic support, guidance and results from investing in our training and courses This type of progress requires that you follow the course and do the work. You must demonstrate that you have participated in the Course by accessing course content and starting the methods before requesting cancellation of your course and refund. We may request the submission of completed worksheets, activities and exercises in considering your refund request. A change of mind does not constitute a valid reason for cancellation and request for a refund. In considering your refund we may also charge an admin fee at our discretion.

(a)Requests for refunds must be made in writing to me within the defined refund period as listed above at eryn@believeinmagic.dog

(b) If you receive your money back you must delete every copy of the product that you have downloaded as well as copies you have placed on other devices or media.

Tickets to Live Webinars are non-refundable but are completely transferable. If you would like your ticket to be transferred to someone else, please email their full name and email address to info@believeinmagic.dog no less than 2 working days prior to the event.

Live Webinars: Believe In Magic Dog Training & Behaviour reserves the right to change the event at any time, this includes time and date. In the unlikely event that this will happen, every effort will be made to ensure a Live Webinar of an equivalent topic and standard on a similar day and time to the originally planned webinar.

 

Behaviour

Believe In Magic Dog Training & Behaviour reserves the right to prohibit entry or eject any person from the Webinar based on behaviour deemed inappropriate by Believe In Magic Dog Training & Behaviour staff and/or its agents and others working under its authority.

 

 

Engagement and Commitment

By consulting Believe In Magic Dog Training & Behaviour with regard to your dog’s behaviour, you agree to fully engage with the process to the best of your ability and understand that any changes will involve commitment and consistency, in line with the pledge set out below. The pledge (below) sets out the responsibilities of both parties and is a gesture of your commitment to, and understanding of, the process which you are undertaking.

Disclaimer and Waiver of Liability

I understand that working with dogs and modifying behaviour poses a risk of injury. I agree to ensure that necessary steps are taken at all times to prevent injury to myself, my dog(s) and others, including the use of a muzzle and avoidance of situations that might trigger aggressive behaviour. I agree to indemnify and hold harmless Believe In Magic Dog Training & Behaviour (Eryn Martyn-Godfrey) against any and all losses, liabilities, judgments, awards and costs (including legal fees and expenses) arising out of, or related to, any claim of injury to persons or property of any kind, whether before, during or after the consultation and when implementing suggested techniques with my dog(s).

  • To use my professional judgement, expertise and experience to decide upon appropriate strategies to help you and your dog(s)
  • To clearly explain what behaviour modification or training strategies I am suggesting and why I am suggesting them to you
  • To answer any questions you may have to the best of my ability
  • To make it clear that behaviour modification is not a ‘quick fix’; it will require commitment and changes to be made on your part in order to bring about change in your dog(s)
  • To offer ongoing support, in line with the service(s) for which you have paid (additional follow-up support be purchased – see website or ask us for more details)

Your Responsibilities

  • To be open and honest in providing information to assist me in understanding the problems
  • To ask for clarification if anything which is explained to you is unclear
  • To have an open mind with regard to potential solutions, changes and strategies
  • To commit to agreed behaviour modification strategies and make any necessary agreed changes in order to help resolve the problems you are experiencing with your dog(s) and to understand that behaviour modification is not a ‘quick fix’
  • To try your best to ensure that everyone regularly involved with your dog(s) understands and engages in the process in order to avoid confusion and conflict
  • To avoid introducing alternative training or behaviour modification methods (such as those picked up from TV, books, friends or other trainers) in order to avoid confusion and conflict
  • To ensure that your dog is properly supervised at all times. This includes ensuring that any interactions between your dog and a third party (including your family and any other pets) are safe for both the dog and the others involved.
